These General Terms of Enrolment (“GTE”) together with the Appendices, and any other attachments (if any), College Policies, and any other documents incorporated by these GTE comprise the “Agreement” as referred to in these GTE. Capitalized terms used herein (including the Appendices) but not otherwise defined will have the meaning ascribed to them in Clause 9 of this Agreement.

 

For the avoidance of doubt, any Student who attends a course (whether in part or in full, regardless of whether the Fees have been paid and whether the GTE and the Agreement have been executed) shall be deemed to have agreed to be bound by the terms and conditions in this GTE and the Agreement.

Entrance criteria: All Parties agree that the Student’s entry and enrolment into the College may be subject, amongst other matters, to the College entrance criteria and that the Student may be asked to take a test or to be interviewed in order to ascertain whether the entrance criteria have been met, which may include testing for the Student’s English language proficiency, learning support needs and/or academic level. All Parties further agree that the responses provided during all tests and evaluations, if provided by the College, must be solely those of the Student’s. If it subsequently becomes apparent that this has not been the case, it will lead to the withdrawal of the offer of a place or removal from the College without refund of any fees paid.

  • Account: An Account shall be registered with the College before the official enrolment of the Student. For the avoidance of doubt, if the Student is below 18 years of age, the Account to be registered shall be in the name of the Guardian of the Student.
  • Course Fees: The fees (“Course Fees”) for Students comprise the enrolment fee, the tuition fees and development levy.
  • Course Fees for offers made to commence during the course: Where a student joins part way after the commencement of the course, the Course Fees payable shall not be prorated.
  • Course Fees: Course Fees are payable in full regardless of (i) the respective length of each course, (ii) whether or not the Student joins part way through the course, or (iii) whether or not Students miss classes.
  • Payment of Course Fees: The Course Fees for each course shall be paid prior to the start of the start of the course in full and such fees are not refundable in whole or in part. Party A agrees and undertakes to use one of the College’s accepted payment methods.
  • Increase in Course Fees prior to commencement: Where there is an increase in Course Fees in between the time the Party A executes this GTE and the Student starting at the College, the increase will be invoiced separately prior to the Student starting at the College.
  • Additional Payments: Details of compulsory items not covered in Course Fees (“Additional Payments”) shall be invoiced to the Account separately. Such fees may include fees and/or cost of any external examination or assessment which a Student participates in, or is registered to participate in, whether prior to the start of the examination or assessment period or otherwise and whether the Student in fact attends the examination or assessment or otherwise. All Additional Payments are non-refundable.
  • Forfeiture of Fees upon withdrawal: The Fees, will be immediately forfeited where, for any reason, acceptance of a place is cancelled by Party A before the commencement of the course or a Notice of Withdrawal is submitted by Party A after the commencement of the course as outlined in Clause 3. The College shall have the sole discretion to consider exceptional cases on written request by Parties.
  • Loss or damage caused by a Student: The cost of any loss or damage caused by a Student will be charged to the Account.
  • Increase in Course Fees or Additional Payments during enrolment: The Parties acknowledge that fee adjustments may be made periodically. Any increase in Fees during the term of the course will be invoiced separately to the Account.
  • Fees paid for a partially completed course are non-refundable: No Fees shall be refunded or waived for a course that a Student has commenced but did not complete for any reason including but not limited to absence through sickness.
  • Responsibility for payment: All Parties shall share joint and several responsibility for the full payment of Fees. The College may withhold any information or use of any property while fees are unpaid.
  • Payment of Course Fees by a Third Party: An agreement with a third party to pay the Fees or any other sum due to the College does not release Party A from any liability under this Agreement. The College reserves the right to refuse a payment from a third party.
  • Late payment: The College has the right to impose late payment charges, including all related administration and legal costs, for invoices not paid by the due date. The amount outstanding, the late charges, and all related costs are payable by Party A. If Party A consists of more than one person, the Parties shall be jointly and severally liable for the total amount outstanding. Any payment made or delivered to the College after the due date will not be considered as paid until the payment has cleared. Any sum tendered that is less than the sum due and owing may in any event be accepted by the College as part payment of the amount outstanding.
  • Withdrawal from the College: Notice must be given in the prescribed form on or before the published dates of notification before a Student is withdrawn from the College. If the Student is below 18 years of age, the consent of the Guardian shall be required before a Student is withdrawn.
  • Prescribed form of Withdrawal Notice: Notice of withdrawal must be submitted to and acknowledged by the College to be deemed to constitute effective notice for the purposes of this Agreement.
  • Reinstatement: Reinstatement shall only be available for the immediate course from which the Student withdrew. All reinstatement requests must be made to the College and are subject to the consent of the Teacher and the Principal.
  1. Suspension: A Student may be temporarily excluded from attending the College, including College-related activities held on or off campus, at any time, without refund of Fees, if, in the opinion of the Principal:
    1. the conduct or progress of the Student has been unsatisfactory;
    2. the Student is unwilling or unable to benefit from the educational opportunities offered; or
    3. a Guardian has treated the College or members of its staff unreasonably.
  2. Expulsion: A Student may be expelled at any time without refund of Fees, if in the opinion of the Principal:
    1. the Student’s conduct, whether on or off College premises or during the duration of the course, has been prejudicial to good order or discipline or to the reputation of the College;
    2. the Student has been charged or convicted of a serious offence under the laws of Singapore;
    3. the Student is unwilling or unable to benefit from the educational opportunities offered;
    4. a Guardian has treated the College or members of its staff unreasonably; or
    5. a Guardian has refused and/or persistently neglected to abide by this Agreement.
  3. Power of the Principal: The Principal’s powers include the imposition of sanctions including exclusion for non-payment of Fees, suspension during investigation or following a breach of College discipline, and removal or expulsion as provided in this Agreement. The Principal is not responsible for a Student who is absent from the College or in breach of College Policies or present on campus for reasons other than for College-related activities.
  4. Discretion of Principal: The decision to exclude, suspend or expel a Student and the manner and form of any announcement shall be at the sole discretion of the Principal. In no circumstances shall the College or its staff be required to divulge to the Parties any Confidential Information or the identities of Students or others who have given information which the Principal has acquired during an investigation and which has led to the suspension, or the requirement to remove the Student.
  5. Access: A Student who has been withdrawn, excluded, suspended, removed or expelled from the College has no right to enter College premises without the written permission of the Principal. Similarly, any Guardian who has been asked to leave under Clauses 4(a)(iii), 4(b)(iv) and 4(b)(v) will have no right to enter the College premises without written permission of the Principal.
  1. ALL OBLIGATIONS OF THE COLLEGE PURSUANT TO THIS AGREEMENT ARE PERFORMED ON AN “AS IS”, “AS AVAILABLE” BASIS, AND ALL PARTIES SHALL RELY ON THE COLLEGE SOLEY AT THEIR OWN RISK. THE COLLEGE DOES NOT MAKE, AND HEREBY DISCLAIMS, (I) ALL EXPRESS WARRANTIES WITH REGARD TO ITS OBLIGATIONS HEREIN, INCLUDING BUT NOT LIMITED TO ANY WARRANTY THAT THE OBLIGATIONS PROVIDED HEREUNDER WILL BE UNINTERRUPTED, OR ERROR-FREE; AND (II) ANY AND ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY’S INTELLECTUAL PROPERTY RIGHTS.
  2. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, IN NO EVENT WILL THE COLLEGE BE LIABLE TO ANY PARTY FOR (I) LOST PROFITS; (II) LOSS OF BUSINESS; (III) LOSS OF REVENUES; (IV) LOSS OF DATA OR INTERRUPTION OR CORRUPTION OF DATA; (V) ANY CONSEQUENTIAL OR INDIRECT DAMAGES, INCLUDING LOSS OF EARNINGS OR FUTURE EARNINGS; OR (VI) ANY INCIDENTAL, SPECIAL, RELIANCE, EXEMPLARY OR PUNITIVE DAMAGES (IF APPLICABLE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
  3. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, THE COLLEGE’S TOTAL LIABILITY TO THE PARTIES IN THE AGGREGATE (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY IN TORT OR BY STATUTE OR OTHERWISE) FOR THE ENROLMENT (AND REGARDLESS OF WHETHER THE CLAIMS ARE BROUGHT DURING OR AFTER THE ENROLMENT) WITH RESPECT TO ALL CLAIMS ARISING FROM OR RELATED TO THE SUBJECT MATTER OF THIS AGREEMENT (INCLUDING ATTORNEY’S FEES) WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE PARTIES TO THE COLLEGE FOR THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE MONTH IN WHICH THE FIRST CLAIM AROSE. AS A FURTHER LIMITATION, THE COLLEGE’S MAXIMUM LIABILITY FOR ANY CLAIMS RELATING TO OPTIONAL LESSONS OR ACTIVITIES OFFERED OR PROVIDED BY THE COLLEGE SHALL NOT EXCEED THE AMOUNT OF THE FEES FOR SUCH LESSON OR ACTIVITY GIVING RISE TO THE CLAIM.
  4. THE LIMITATIONS SET FORTH IN CLAUSES 5(b)-(c) WILL APPLY TO ALL CLAIMS AND CAUSES OF ACTION, REGARDLESS OF WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHER THEORY.
  5. The Parties each waive the right to bring any claim against the College arising out of or in any way relating to this Agreement more than one (1) year after the date this Agreement expires or is earlier terminated.
  1. Party A shall not disclose Confidential Information of the College without the prior written express consent except where the disclosure is required by applicable law or regulation or by an order of a court or other governmental body having jurisdiction (i) after giving reasonable notice to the College with adequate time for the College to seek a protective order and (ii) provided that Party A uses diligent reasonable efforts to limit disclosure. The Parties agree and undertake to be responsible for ensuring that any Confidential Information of the College that Party A discloses pursuant to this Agreement (other than disclosures pursuant to the above is kept confidential by the person receiving the disclosure to the same extent that Party A must keep the information confidential.
  2. The title or right to possess Confidential Information shall remain with the College and the College does not grant Party A the right to use its trademarks, service marks, trade names, logos, copyrights, or other intellectual property rights or other designations in any promotion, publication, or press release without the prior written consent of the College. The College may publicly refer to Party A, orally and in writing, as a Guardian or Student of the College without obtaining consent from Party A.
  1. Families: It is normal for Colleges to interact with families rather than individuals. In the College’s interactions with families we will, as a matter of routine, consider permissions and instructions from any Guardian as binding on the family. The College may share information about the course from time to time between family members of the Student as necessary, subject to the College Data Protection Policy and the laws of Singapore. The family in this case will be defined as a group of individuals identified to us as a single family during the application process and normally related as spouses/partners (including same-sex relationships), mother/father, brother/sister or any similar step relationship or legal guardianship. Any changes to these relationships should be notified to the College in writing immediately.
  2. College Policies: All Students must observe and abide by College Policies at all times.
  3. Liability and insurance: The College shall not be held liable to the Student, and where applicable, the Guardian, for any injury, death or loss of property of the Student. The College is further not responsible for the Student’s personal property on its campuses or on the way to or from the College or on any College-sponsored activity or trip away from the College. The College is not the agent of the Guardian for any purpose related to insurance. All Students, and where applicable, their Guardians, shall be solely responsible for providing the Student’s medical and accident insurance as well as personal property insurance. Guardians should satisfy themselves with the adequacy level of cover offered to their personal circumstances.
  4. Students’ personal property: Students are responsible for the security and safe use of their own personal property and are responsible for ensuring that all such property is clearly marked with the owner’s name.
  5. Concerns/complaints: Guardians who have cause for serious concern as to matters of safety, care or quality of education must inform the College.
  6. Additional learning needs: Where a member of staff has a concern about the progress of a Student they will make a preliminary assessment to see whether learning support is needed. If it appears that further assessment by an educational psychologist is advisable or the Student is falling behind with studies, the Parties will be notified. The Parties agree that further assessments may be arranged by the College or Party A at the latter’s expense. The Parties hereby acknowledge that our staff are not qualified to make a medical diagnosis of conditions. The Parties will be asked to withdraw the Student from the College without being charged any Fees in lieu of notice if the Principal considers, at his/her sole discretion, that the College cannot provide adequately for the Student’s educational needs.
  7. Withholding information: If it subsequently becomes apparent after admission that any information regarding learning support, special needs, physical or mental health conditions has been withheld, or falsified, during the application process, it will lead to the immediate removal of the Student from the College without refund of any Fees.
  8. Data protection: The College Data Protection Policy sets out how the College collects, process and discloses personal data about Students and their Guardians, so that the College can provide services necessary to each Student’s education and appropriate to the Guardian’s membership of the College community. The policy is written in accordance with the relevant Singapore Data Protection laws. Guardians to Students under the age of 18 further agree to the College using their own and such Student’s data in accordance with the stated policy. The College’s Data Protection Policy is available on the College website and may be amended from time to time.
  9. Confidentiality: The Parties acknowledges and agrees that the College, its officers and staff may obtain, hold, use and communicate, on a ‘need-to-know’ basis, Confidential Information which, in the opinion of the College, is material to the safety and welfare of the Student and others. The Parties further consent to the College communicating with any other schools which the Student has attended, or currently attends or which Party A proposes the Student should attend about any matter concerning the Student or about payment of Fees, whether or not the information being passed on is also held in machine readable form.
  10. Examinations, reports and references: The College will enter a Student’s name for an examination if the Principal is satisfied that such is in the best interests of the Student. Information concerning the progress and character of a Student and about examination, further education and career prospects and any references will be given to the Parties without liability on the part of the College. Where the parents of a Student are separated or divorced, reports and other information will be made available to both parents at their separate requests unless certified true copies of court orders prohibiting the same are produced to the College.
  11. Intellectual property: The College reserves all rights and interests in any intellectual property rights arising as a result of the actions of a Student in conjunction with any member of staff of the College and/or other Students at the College for a purpose associated with the College. Any use of any such intellectual property rights by a Student is subject to the consent of the College upon terms and conditions acceptable by the College. The College may, at its discretion, allow the Student’s role in creation/development of intellectual property rights to be acknowledged.
  12. The use of videos, photographs and images: The Parties agree to the College using Students’ work, photographs and video footage of the Student and other material for purposes such as publicising the College and its Students’ accomplishments to internal and external audiences, in print and online, including on social media, in accordance with the relevant College Policies.
  13. Marketing and promotional activities: The College’s marketing material, including but not limited to the College website, brochures and open days describe the broad principles on which the College is presently run and give an indication of our approach, ethos and curriculum content. The information provided is not intended to be legally binding and does not form part of any agreement between the College and the Parties.
  14. Entire agreement: This Agreement and the Acknowledgement signed by the Parties supersede any other prior agreements, either oral or in writing. The Parties acknowledge that no representation, inducements, promises or agreements, orally or otherwise, have been made by any officers or staff of the College.
  15. Partial invalidity: If any terms and conditions under this Agreement is being held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force, without being impaired or invalidated in any way.
  16. Governing law: This Agreement shall be governed and construed in accordance with the laws of the Republic of Singapore.
  17. Dispute resolution: The College and Party A agree that any dispute, controversy or claim arising out of or in connection with this Agreement (including any question regarding its existence, validity or termination), shall before or after the commencement of any other proceedings, be first referred to mediation in Singapore at the Singapore Mediation Centre in accordance with its Mediation Rules for the time being in force, without prejudice to any recourse to apply to any tribunal or court of law of competent jurisdiction for any form of interim relief. If the dispute cannot be resolved through mediation within 8 weeks after the commencement of mediation at the Singapore Mediation Centre, or within such extended period as may be agreed by the College and Party A, the College and Party A shall submit to the exclusive jurisdiction of the courts of Singapore.
  18. Counterparts: This Agreement may be executed in one or more counterparts, each of which shall be deemed an original and all of which shall be taken together and deemed to be one instrument.
  19. Interpretation: Headings are for ease of reading only and are not otherwise part of this Agreement.
  20. Conflicts: In the event of ambiguity, conflict or inconsistency among the documents comprising this Agreement, the documents shall be given a descending order of precedence as follows: (i) the provisions of this GTE herein; (ii) the Appendices, Exhibits, and any other attachments to this GTE; (iii) the College Policies.
  21. Student and Guardian: If the Student is under 18 years of age, the Guardian takes responsibility and is liable for all obligations of the Guardian and the Student under the Agreement. If the Student is 18 years of age and above, and the Guardian executes this GTE, then both the Guardian and the Student jointly and severally takes responsibility and is liable for all obligations of the Guardian and the Student under the Agreement. If the Student is 18 years of age and above, and the Guardian does not execute this GTE, then the Student takes sole responsibility and liability for all of the Student and Guardian’s obligations under the Agreement.

Release from obligations affected by Force Majeure: If by reason of Force Majeure (hereafter defined) the College is rendered unable wholly or in part to perform its obligations, then upon notice in writing of such Force Majeure to the Parties as soon as reasonably practicable after the occurrence of the cause relied on, the College shall be released from such obligations to the extent to which they are affected by the circumstances of Force Majeure and for the period during which those circumstances exist. For the avoidance of doubt, ‘Force Majeure’ herein means any of the following events: a) war, invasion, rebellion, revolution, insurrection or civil war; b) act of Government; c) earthquakes, fire, lightning, storms, floods or any other occurrence caused by the operation of the forces of nature; d) strikes, lockouts, boycotts or labour disputes; e) terrorism, sabotage or arson; f) epidemic or infectious disease; or g) any other event similar to any of the foregoing or any other event beyond the control of the College.

Account: the account to be registered with the College before the enrolment of the Student for the purposes of payment of Course Fees or Additional Payments as described in Clause 2(a).

Additional Payments: Shall have the meaning ascribed to it in Clause 2(g). 

College:  United Ceres College.

College Policies: Shall have the meaning ascribed to it in Clause 1(a) of Appendix 2.

Confidential Information:  In relation to the College, all information in relation to the conduct and activities of the College, whether or not expressed in writing, whether marked or not marked as confidential or  any other words in any language that have similar meanings, in whatever form, including but not limited to, business plan, strategies, affiliations, customer lists, characteristics, and identities, technical information and know-how, performance or process data, marketing sensitive information, corporate existence, ownership and governance, products and services (now existing or proposed), any and all information generated by such products or services, financial information, system or program specifications and business methods, and any discussions that are taking place between the College and Party A, but shall not include any information which:

  • was publicly known and made generally available in the public domain prior to the time of disclosure by the College;
  • becomes publicly known and made generally available after disclosure by the College to Party A through no action or inaction of Party A;
  • is already in the possession of Party A through a lawful channel at the time of disclosure by the College and was not acquired directly or indirectly from the College immediately prior to the time of disclosure;
  • is obtained by Party A from a third party without a breach of such third party’s obligations of confidentiality; or
  • is independently developed by Party A without use of or reference to the College’s Confidential Information, as shown by documents and other competent evidence in Party A’s possession.

Course Fees:  Shall have the meaning ascribed to it in Clause 2(b).

Fees: Shall refer to both Course Fees and/or Additional Payments, or any other such costs incurred by the College on behalf of the Student during the term of the Student’s enrolment in the College.

Guardian: Any person having parental responsibility or legal custody of the Student, including the a birth or adoptive parent of the Student, or a legal guardian.

Medical Action Plan: Shall have the meaning ascribed to it in Clause 2(d) of Appendix 2.

Party A: Shall refer to any Student and/or Guardian who executes this GTE, and who shall be bound by the Agreement pursuant to Clause 7(u), and “Parties” shall refer to two or more of them.

Principal: Shall have the meaning ascribed to it in Clause 1(b) of Appendix 1.

Students: All Students presently or previously enrolled in the College regardless of age.

  1. Background
  1. The College: The College is United Ceres College of Singapore.
  2. The Principal: The principal of the College (“Principal”) is the person appointed by the College on each campus to be responsible for all Students and includes those to whom any of the duties of the Principal have been delegated including members of the leadership teams of the College.
  3. Guardians: All Parties named in the Acknowledgements shall be jointly and severally liable to the College. Unless otherwise informed in writing with supporting documentary evidence, the Guardians named in the Acknowledgements shall be deemed to have equal parental responsibility. For the avoidance of doubt, in the absence of a notice in writing together with such relevant documents as required by College of a change of family circumstance, the College shall not be responsible for accepting the instructions from one Guardian without confirmation from the other Guardian.
  4. Aim of the College: The College is dedicated to providing Students with the skills they need to thrive in a rapidly changing world. The College’s diverse programs are meticulously designed to empower students to inspire them to become innovators and leaders, and prepare them to navigate and contribute meaningfully to an increasingly interconnected world.
  5. Acceptance of Agreement: Attendance at the College indicates acceptance of this Agreement and agreement to abide by College Policies. The Appendices, Exhibits, any other attachments to this GTE and the College Policies, as varied from time to time, shall form part of this Agreement.
  6. Waiver of Standard Terms and Conditions: Any waiver is effective only if given in writing by the Principal personally.
  1. Care, Attendance and Behaviour
    1. College Policies: It is a condition of remaining at the College that parents and Students accept all procedures, rules regulations, practices and policies implemented by the College (“College Policies”), which shall be made available to the Parties and amended from time to time.
    2. Guardian’s Authority: The Parties hereby authorise the Principal to implement and execute all decisions that safeguard and promote the Student’s welfare. The Parties shall’ consent to such physical contact as the College may deem necessary for teaching and for providing comfort to a Student in distress or to maintain safety and good order or in connection with the Student’s health, and for the purposes of receiving medical treatment. All such expenses incurred will be charged to the Account.
    3. Behaviours: The College attaches importance to kindness, integrity and respect. All members of the College community (including but not limited to Students, parents, staff, volunteers and alumni) are expected to conduct themselves with these values in mind and to support and uphold the aims of the College and its good name. The Parties will endeavour to conduct themselves in accordance with our guidelines and College Policies, and to support the College’s ethos and values.
    4. Attendance:
      1. The Parties will use their best endeavours to ensure the Student participates in the activities of the College including but not limited to attendance of each school day (unless prevented by illness).
      2. The Student will be required to maintain a satisfactory, minimum attendance over any given period and in accordance with Singapore Government regulations. Failure to do so without authorisation may result in the Student being asked to leave the College without any refund of fees.
  2. Student Health, Medical Matters and Wellbeing
    1. Declaration of Student’s health: In order to promote positive health and wellbeing within the College community, staff and parents are expected to declare medical, behavioural and psycho-emotional conditions which may affect the Student’s capacity to participate in the educational programme or present a greater risk or require individual medical support, and provide a medical report or memo to enable best medical practice is applied and risk of harm or danger is minimised. Failure to provide full disclosure and/or agree to a Medical Action Plan or non-compliance may, at the sole discretion of the College, result in the termination of the Student’s position at the College and/or barring of that Student’s participation in College activities and trips.
    2. Concern for a Student’s physical or mental health: Where the College has a reasonable concern about a Student’s physical or mental health, the College may require the results of a medical or psychological examination before the Student is permitted to enter the campus.
    3. Medical information: Throughout a Student’s time at the College, the College shall have the right to disclose information about the Student if considered to be in the Student’s own interests or necessary for the protection of other members of the College community and service providers responsible for the duty of care of Students. Such information will be given and shared on a ‘need-to-know’ basis.
    4. Medical Action Plan, Duty of Care: Where a Student has a confirmed medical condition, a mutually agreed medical action plan with stated and agreed interventions may be required (“Medical Action Plan”). It is a condition of continuing admission to the College that all agreed medical devices and medication required to support the agreed interventions in the Medical Action Plan are provided free of charge to the College and in the quantity stated in the Medical Action Plan or associated College Policies to College medical staff, whilst the Student is in the custody of the College. Where there is concern, the suitability of the Student to participate in College activities, including College-organised trips, is for the Principal to decide.
    5. Infection control and student illness: Students shall not attend their courses if they show symptoms of an infectious disease. All Parties shall comply with the College Infectious Disease Policy. Students shall be required to provide a medical certificate confirming a contagious condition and which also details when the Student is fit to return to the College. If the Student has been exposed to a known contagious or communicable disease, illness or virus in Singapore or abroad, the Parties agree to inform the College immediately.
    6. Medical closure: In the event of a medical event or circumstance within or affecting Singapore or the College that requires the College to be closed by the relevant authorities of the Singapore Government or by recommendation to break a cycle of infection, the College will not be obliged to refund all or any part of the Course Fees for any period of closure before or after any such event. In this situation, the College will make arrangements, where practicable, to ensure continuity of the Students’ education.
    7. Drugs testing: All Parties acknowledge and agree that the Principal may at any time require the Student to give a biological sample under medical supervision to test for the use of illegal drugs or other substances damaging to health in line with the College’s Drugs Policy and Drugs Testing Protocol. A record of such a sample will not form part of the Student’s permanent record with the College.
    8. Safeguarding and risk:
      1. Students: the College is committed to safeguarding and protecting Students and all community members from harm. Student Safeguarding is everyone’s responsibility. The College has the sole discretion to collect and share safeguarding information about individual Student with schools the Student has attended or will attend. With regard to alleged incidents of Student-on-Student abuse, the College may further, in its sole discretion, impose protective and/or supportive interim measures (“Interim Measures”) after a report is made and before the investigation result, if any, is reached. Interim measures may include but are not limited to:
        1. Imposing non-contact conditions on the Student who has been impacted by the safeguarding incident (the “Complainant”) and the party against whom an allegation of misconduct relating to safeguarding has been made (the “Respondent”), where such non-contact conditions may extend to the close contacts of the Complainant and/or Respondent;
        2. Moving the Complainant and/or the Respondent to alternative classes if the College is of the sole view that such movement is feasible;
        3. Excluding the Respondent from certain parts of the campus; and/or
        4. Excluding the Respondent from specific College-organised trips and/or activities.
      2. Community members: All Parties, staff and community members are expected to support the safety and wellbeing of everyone on campus. Access to the campuses is at the discretion of the College and may be withdrawn. Any Guardian who is deemed to be a risk to themselves or others can be excluded from the campuses and from contact with the community. The College reserves the right to exclude Students from the College as a result of any inappropriate or improper behaviour of their Guardians that may pose a risk to the community or which brings the College into disrepute.
      3. Police reports: In the event that police reports have been made in relation to a safeguarding incident, the College may in its sole discretion postpone its inquiry until the police have completed their investigation if the College is of the view that its inquiry may affect the police investigation.
      4. Police reports: The College shall report to the police any alleged incidents that fall within Section 424 of the Criminal Procedure Code 2010 (including but not limited to offences affecting the human body).
    9. Assumption of Risk: Except for cases of gross negligence by the College, all participation in College activities or expeditions shall be done at the Student’s own risk and that the College shall not be liable or responsible for any accident, personal injury or death sustained or suffered by the Student or any damage to property caused while the Student is participating in such activities. All Parties further agree to indemnify the College from all claims whatsoever and howsoever caused, sustained or suffered by the Student whilst participating in any such College activities or expeditions, whether under contract or tort law or otherwise.
